- Definitions
The data protection declaration of MafoMay is based on the principles used by the European Directive and Regulation makers in the course of the introduction of the GDPR. Our data protection declaration serves to inform the public, our customers and our test persons. The terms used therein are described in more detail below.
We use the following terms (among others):
- a) “personal data”
According to Article 4 No. 1 of the GDPR, personal data is any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Personal data of a person include e.g. name, age, marital status, vehicle and insurance number, current residence, health conditions (e.g. health data, genetic disposition), passport and X-ray images, credit data, data on the transfer and promotion of a person, but also value judgments about his qualifications and character traits.
- b) person concerned
A data subject is a natural person whose personal data are processed by the controller.
- c) Processing
Processing means any operation or set of operations which is performed upon personal data, whether or not by automatic means. This includes collection, recording, organization, arrangement, storage, adaptation, updating or alteration, retrieval, consultation, use, disclosure or communication by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
- d) Restriction of processing
Restriction of processing is the expression to limit the stored personal data in their future processing.
- e) Profiling
Profiling is the term used to describe any automated personal data processing operation that has the purpose or effect of evaluating personal aspects relating to an individual, in particular with a view to analyzing or predicting aspects of that individual’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or change of location.
- f) Pseudonymization
Pseudonymization refers to the processing of personal data in such a way that the personal data can no longer be assigned to the data subject without additional information. This additional information must be available and stored separately, so that technical and organizational measures are in place to ensure that the data cannot be assigned to the identified or identifiable natural person.
- g) Controller or person responsible for processing
Controller or data controller is the person (natural or legal), public authority, agency or other body which determines the purposes and means of the processing of personal data. If these are prescribed by EU or national law, the specific criteria of designation may be provided for under Union or Member State law.
- h) Processor
Processor means a natural or legal person, public authority, agency or other body that processes personal data on behalf of the Controller.
- i) Recepient
A recipient is a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not a third party. However, public authorities that may receive personal data in the context of a specific investigation mandate under Union or Member State law shall not be considered as recipients.
- j) Third Party
Third party means a person, organization or entity other than the data subject himself/herself, the controller, the person entrusted with the processing and anyone authorized to process the personal data under the responsibility of the controller or the processor.c
- k) Consent
Consent is an unequivocal expression of will given voluntarily by the data subject for specific cases under informed consent. It may take the form of a declaration or other unambiguous affirmative act by which the data subject expresses his or her consent to the processing of personal data relating to him or her.
